Procedural Posture

Civil Case / Ruling on Interlocutory Application

  1. 1 Whether the court can issue declaratory orders at the interlocutory stage before pleadings are closed.
  2. 2 Whether the plaintiff is entitled to interim injunctive reliefs restraining the defendants from engaging in practices alleged to contravene the Auctioneers Act.
  3. 3 Whether the application raises issues that would result in prejudgment of the substantive dispute.

Ratio Decidendi

The court held that declaratory orders cannot be issued at the interlocutory stage, especially where the parties have not filed their statements of defence and the facts and law have not been fully canvassed. Granting such orders would amount to a prejudgment of the substantive dispute, which is impermissible. The court further found that the interim injunctive reliefs sought had lapsed with the delivery of the ruling and were not necessary to consider. Consequently, the plaintiff's Notice of Motion was dismissed as it was not suitable for determination at this stage of proceedings.
