The Court of Appeal found that the applicant had demonstrated an arguable appeal, as the issues raised were not frivolous and warranted judicial consideration. The court further held that payment of the substantial decretal sum prior to determination of the appeal would likely cause considerable hardship to the applicant, especially if the appeal succeeded. Given that both parties are reputable banking institutions, the court determined that the interests of justice required granting a stay of execution to preserve the subject matter of the appeal and prevent the appeal from being rendered nugatory. The application for stay was therefore allowed, with costs to be in the appeal.
