The court found that the initial sum of Kshs 50,000 advanced to the defendants was secured by a charge instrument that expressly capped the interest rate at 14% per annum and the secured sum at Kshs 100,000. The plaintiff was not entitled to charge interest above 14% without the defendants' consent, nor to recover more than the secured sum under the charge. For the subsequent unsecured loan of Kshs 150,000, the court determined that there was no evidence of an agreed interest rate of 40% per annum as claimed by the plaintiff.
