This act released Jirongo from liability under the deed, as the plaintiff could not pursue both the defendant and Jirongo simultaneously. The plaintiff's conduct amounted to rescission, and it must now continue to pursue the defendant for the debt. The application to enjoin Jirongo and execute against him was therefore without merit and dismissed.
