Ratio Decidendi

The court held that under Order V rule 1 of the Civil Procedure Rules, a summons is valid for twelve months from the date of issue and may only be extended if an application is made within that period. If the validity of the summons is not extended within the twelve months, the summons expire and the court lacks jurisdiction to extend or revive them. The applicant's failure to seek extension within the prescribed period was fatal to the application. The authorities cited by the applicant, both local and foreign, do not support the extension of expired summons. Therefore, the court dismissed the application for extension of the validity of summons as it was not legally sustainable.
