The defendant was granted overdraft facilities with an agreed limit and interest rate of 14% per annum, subject to variation upon notice. The defendant drew cheques exceeding the agreed limit, and the bank honoured them, making the defendant liable for the total sum paid out. However, the bank failed to provide evidence of giving notice to the defendant before increasing the interest rate to 40% per annum. The court found that, in the absence of such notice, the plaintiff was only entitled to charge interest at the agreed rate of 14% per annum. The only additional recoverable charge was legal fees of Kshs.204,185/-, as no other charges were substantiated. The defendant is therefore liable...
