Ratio Decidendi

The court found that the correspondence and documents relied upon by the Defendant did not constitute plain and obvious admissions by the Plaintiff that would entitle the Defendant to summary dismissal of the suit under Order 13 Rule 2 of the Civil Procedure Rules. While the Defendant gave notice to terminate the tenancy and vacated the premises by 30th September, 2006, the evidence showed that the keys were not surrendered and possession was not handed over until 6th December, 2006. The Plaintiff's claim for rent and service charge for the fourth quarter of 2006 was therefore not conclusively answered by the alleged admissions.
