The Business Premises Rent Tribunal does not have jurisdiction to grant a stay of execution pending appeal to the High Court, as its powers under Section 12(1)(i) of Cap 301 are limited to varying or rescinding its own orders, not staying them pending appeal. The High Court, however, has jurisdiction under Order XLI Rule 4(1) of the Civil Procedure Rules to grant a stay of execution in such circumstances. The principles governing the grant of stay in possession suits are well settled: a stay should be granted to preserve the subject matter of the appeal and prevent the appeal from being rendered nugatory, unless there is an overwhelming hindrance.
