The Court of Appeal held that under the Auctioneers Rules, the process of attachment is initiated by proclamation, which constitutes legal seizure of the goods and entitles the auctioneer to fees for attachment. However, the court found that the fees should be assessed based on the value of the goods actually attached, not the decretal sum, as the purpose of the fee is to remunerate the auctioneer for the actual work done. Since there was insufficient evidence of the value of the attached goods, the court set aside the assessed fee of Kshs.1,000,000 and remitted the matter to the Deputy Registrar for reassessment based on the value of the properties described in the proclamation.
