The court found that L.R No. 9042/179 had been lawfully allocated and registered in the name of Beta Enterprises Ltd in 1988, and subsequently transferred to the Plaintiff, making it private property. The purported allocation and grant of L.R No. 9042/23 to the 1st Defendant in 1995 was therefore illegal and void, as the land was no longer unalienated government land. The Commissioner of Lands' own correspondence admitted the error. The Plaintiff's title was clear, indefeasible, and not subject to any encumbrance or third-party claim.
