No draft defence was provided, and the debtor acknowledged the debt, proposing only a mode of repayment. The Tribunal held that the default judgment was regular and there was no basis to set it aside. However, considering the debtor's financial situation and the substantial recovery already made by the claimant through deposits and sale of collateral, the Tribunal exercised its discretion to allow the judgment debtor to settle the remaining decretal amount by monthly installments of Kshs.40,000.
