The tribunal found that the cause of action did not accrue in 1997 when the claimant was allotted the plot and paid for it, but rather on 12th August 2019 when the respondent failed to issue the title deed following a demand letter. Therefore, the claim was not time barred under the Limitation of Actions Act. On the issue of the Law of Contract Act, the tribunal held that the requirements of section 3(3) did not apply to the contract in question due to section 3(7), and that the special relationship between a co-operative society and its members, as well as the need to avoid undue technicalities, meant the matter should proceed to full hearing.
