Miscellaneous Criminal Application / Ruling on Application for Resentencing After Dismissal of Appeal

  1. 1 Does the High Court have jurisdiction to entertain an application for resentencing after the Court of Appeal has dismissed the applicant's appeal?
  2. 2 Has the applicant met the threshold for a new trial or resentencing under Article 50(6) of the Constitution?.

Ratio Decidendi

The High Court lacks jurisdiction to entertain an application for resentencing or review of sentence after the Court of Appeal has dismissed the applicant's appeal. The constitutional and statutory framework, as interpreted by the Supreme Court and Court of Appeal, prohibits the High Court from revisiting matters already determined by a superior court. The applicant has not demonstrated the existence of new and compelling evidence as required under Article 50(6) of the Constitution to warrant a new trial or resentencing. Therefore, the application is incompetent and must be dismissed for want of jurisdiction.

Court Disposition

Orders
