The Tribunal found that both parties admitted the existence of rent arrears, but the amount was disputed. Upon reviewing the receipts and statements provided, the Tribunal determined the amount of arrears owed by the tenant to be KShs. 172,632.00. The Tribunal further held that, under Section 10 of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act, Cap 301, a landlord cannot lawfully proclaim or levy distress for rent without the Tribunal's authority. The landlord's attempt to proclaim and attach the tenant's movable property without such authority was therefore invalid.
