The court found that while the respondent's preliminary objection was properly raised and that Section 56(2) of the Kenya Deposit Insurance Act, 2012 requires leave of the court to commence or continue proceedings against an institution in receivership or liquidation, the claimant had in fact sought and obtained such leave by an application dated 4th May 2017, granted on 12th October 2017. The preliminary objection was therefore unopposed and not merited, as the claimant had complied with the statutory requirement. The court held that no further leave was necessary and directed that the suit should proceed to hearing.
