Ratio Decidendi

The court found that the Plaintiff failed to prove adverse possession as he did not demonstrate exclusive, open, and uninterrupted occupation of the suit property for the statutory period of 12 years. The Plaintiff's occupation prior to Robert's registration as proprietor was presumed permissive due to the parent–child relationship, and only nine years had lapsed between Robert's registration and the filing of the suit. After the Defendant's registration, only four years had passed. The court also found no credible evidence of fraud in the Defendant's acquisition of the title, as Robert confirmed the sale and transfer, and the Land Registrar found no evidence of fraudulent transaction....
