The Tribunal found that the tenant admitted to being in rent arrears and had not denied authoring an admission letter acknowledging the debt. The Tribunal held that a party seeking equitable relief must come with clean hands, which the applicant failed to do. The Tribunal further held that the respondent's failure to seek leave before levying distress for rent was not fatal, as the relevant statutory provision is permissive, not mandatory. The applicant failed to satisfy the principles for grant of an injunction, and the application was therefore dismissed.
