The Tribunal found that the Claimant, as the account holder, was entitled to access the balance of proceeds from the sale of the suit property, as there was no dispute regarding his entitlement or any legal impediment. The 1st Respondent was under an obligation to release the proceeds less direct expenses related to the sale or loan recovery, which amounted to Kshs. 1,200,000. The Tribunal further held that the Respondent should have released the funds within one month of the auction, and failure to do so rendered the amount liable to interest at Tribunal rates from 1st December 2016.
