Preliminary Objection / Ruling on Preliminary Objection Regarding Jurisdiction and Joinder of Parties

  1. 1 Whether the 2nd defendant was wrongly joined to the suit.
  2. 2 Whether the suit offends section 18(2) of the Land Registration Act regarding jurisdiction over boundary disputes.
  3. 3 What orders should issue, including costs.

Ratio Decidendi

The court found that the 2nd defendant had transferred its interest in the disputed land in 2012 and was neither in possession nor ownership, making its joinder improper as no cause of action was disclosed against it. The court further held that the dispute was a boundary matter, which, under section 18(2) of the Land Registration Act, falls within the exclusive jurisdiction of the Land Registrar unless the boundaries have already been determined. Court Disposition

Preliminary objection allowed; suit dismissed for want of jurisdiction; 2nd defendant struck out; costs to defendants.

Orders

  • The preliminary objection is allowed in entirety.
  • The suit is dismissed for want of jurisdiction.
