Ratio Decidendi

The court found that under Section 15(4) of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act, Cap 301, the Environment and Land Court is the final appellate court for appeals from the Business Premises Rent Tribunal. The previous appeal (ELC Appeal No.16 of 2020) was heard and determined, and the court's decision was final. The current appeal, which seeks to challenge the same issues, is not permissible as no further appeal lies from the decision of the Environment and Land Court. The court therefore lacks jurisdiction to entertain the present appeal, and the Respondent's application to strike out the appeal and vacate interim stay orders is merited.
