The High Court determined that the jurisdiction to hear and determine contempt proceedings arising from orders issued by a magistrate's court is vested in the magistrate's court itself, as provided by Section 10 of the Magistrates' Court Act No. 26 of 2015. The court emphasized that jurisdiction is a fundamental legal requirement and that a court cannot proceed in the absence of jurisdiction. Since the orders alleged to have been disobeyed emanated from the magistrate's court, any contempt application should have been filed before that court. The High Court therefore found that the application was improperly before it and struck it out with costs to the respondent.
