Ratio Decidendi

The court found that the defendant, Francis Gichuki Ndiritu, was registered as proprietor of the suit properties in trust for himself and the plaintiffs as beneficiaries. There was no credible evidence to support the defendant's claims that the 2nd Plaintiff was not entitled to a share or that the 1st Plaintiff's share should bypass him in favor of his children. The plaintiffs established their beneficial entitlement as children (or widow of a son) of Beth Njeri Ndiritu. The trust was therefore determined, and the court ordered that the properties be distributed in equal shares among the three beneficiaries. The defendant was ordered to bear the costs of the suit.
