This is to prevent abuse of the court process and multiplicity of proceedings, as both remedies are mutually exclusive under Section 80 of the Civil Procedure Act and Order 45 of the Civil Procedure Rules. The applicant, having exhausted the review process, was precluded from appealing the original judgment.
