The court found that although the claimant's fixed-term contract expired on 30/09/2015, she applied for renewal in accordance with the contract, and the respondent continued to engage her services and pay her salary for over three months after expiry. This conduct converted the employment relationship into a month-to-month contract under section 35(1)(c) of the Employment Act, 2007. The respondent terminated her employment without giving the required 28 days' notice or providing a valid reason, in violation of sections 35, 41, 45, and 46 of the Act.
