The court found no evidence that the Land Registrar, as opposed to the provincial surveyor, had determined the boundaries or filed a report. The doctrine of exhaustion of remedies requires the plaintiff to first seek redress from the Land Registrar. Accordingly, the court stayed further proceedings and directed the Land Registrar, Nairobi County, to demarcate the boundaries and file a report within 60 days.
