The High Court found that although the applicant was not initially given an opportunity to show cause before the forfeiture order was made, he was subsequently afforded a full hearing on 3rd March, 2021, where his counsel presented reasons for his absence. The trial court considered these submissions and declined to reverse the forfeiture. The High Court held that the applicant was thus given ample opportunity to be heard, and there was no irregularity or breach of natural justice. Consequently, there was no basis for the High Court to exercise its revisionary jurisdiction to set aside the forfeiture order.
