Procedural Posture

Criminal Revision / Ruling on Sentence Review

  1. 1 Whether the sentence imposed for attempted rape was incorrect, illegal, or improper and thus subject to revision.
  2. 2 Whether the trial court erred by not considering the period the applicant spent in custody before sentencing.

Ratio Decidendi

The court held that the five-year sentence imposed on the applicant for attempted rape was the statutory minimum under section 4 of the Sexual Offences Act and was therefore legal and lawful. There was no error, illegality, or impropriety in the sentence to warrant revision under the High Court's revisionary jurisdiction. However, the trial court failed to consider the period the applicant had spent in custody prior to sentencing, as required by section 333(2) of the Criminal Procedure Code. The court thus directed that the sentence should run from 21st June 2022, the date the applicant was taken into custody.

Court Disposition

Application for sentence review dismissed; sentence to run from 21st June 2022.

Orders

  • The application for sentence review is dismissed.
