Miscellaneous Application / Ruling on Substitution Application

  1. 1 Whether the legal representative of a deceased claimant can be substituted to continue the suit.
  2. 2 Whether the cause of action survives the deceased claimant under the relevant law.
  3. 3 Whether the contested nature of the issues precludes substitution of the claimant.

Ratio Decidendi

The court held that the cause of action survived the deceased claimant by virtue of Section 2(1) of the Law Reform Act and Order 24 Rule 3(1) and (2) of the Civil Procedure Rules, 2010. The court rejected the respondent's argument that the contested nature of the issues precluded substitution, finding that the law does not make the degree of contestation a bar to substitution. The right to pursue the claim vests in the legal representative, and the statutory and constitutional provisions safeguard this right. The application for substitution was therefore merited and granted, allowing the applicant to be substituted as the claimant and to amend the memorandum of claim accordingly.

Court Disposition

Orders

  • Leave granted for the applicant to substitute the deceased claimant.
