Ratio Decidendi

The court found that the Chief Magistrates Court at Mavoko lacked pecuniary jurisdiction to hear and determine the Applicant's claim, as the Applicant's gross monthly salary exceeded the statutory limit of Kshs. 80,000. Consequently, the suit filed there was a nullity ab initio. The Employment and Labour Relations Court, guided by binding appellate authority, held that it lacked jurisdiction to transfer a suit filed in a court without jurisdiction to itself. The only remedy available to the Applicant was to withdraw the incompetent suit and file a fresh claim in the court with proper jurisdiction. The application for transfer was therefore disallowed, with each party to bear its own costs.
