Ratio Decidendi

The High Court lacks jurisdiction under Section 18 of the Civil Procedure Act to transfer a suit that was filed in a subordinate court without jurisdiction. The power to transfer suits is only exercisable where the suit was initially filed in a court of competent jurisdiction. Since the subordinate court lacked jurisdiction, the suit was incompetent ab initio, and the High Court cannot regularize or transfer such a suit. The applicant's recourse is to withdraw the incompetent suit and file a fresh one in a court with the requisite jurisdiction. The application to transfer is therefore without merit and is dismissed with costs.
