The court found that the plaintiffs/applicants failed to demonstrate a prima facie case with a probability of success, as it was not established that the land claimed by the defendants (L.R. No. 209/9479) was excised from the plaintiffs' land (L.R. No. 11379/3). The existence of other pending suits involving the same subject matter indicated a risk of multiplicity of proceedings and conflicting orders. Since the plaintiffs did not satisfy the first condition for the grant of an interlocutory injunction as set out in Giella v Cassman Brown, the court declined to consider the remaining conditions. The application for a temporary injunction was therefore dismissed with costs to the defendants.
