Ratio Decidendi

The court held that service of the garnishee order nisi on the garnishee bound the debts in its hands and prevented payment to the judgment debtor or his advocates. The issuance of post-dated cheques did not amount to settlement of the debt, as the debt remains outstanding until the cheques clear. At the time of service of the order nisi, the garnishee was still indebted to the judgment debtor for the relevant sum, and by paying out after service, the garnishee violated the court order. The court therefore made the order nisi absolute and directed the garnishee to pay the applicant the attached sum and costs.
