The respondents only filed their claim for adverse possession after the eviction had already taken place. The court held that adverse possession cannot be claimed after eviction, as the essential element of continuous and uninterrupted occupation is lacking. The caveats registered by the respondents therefore had no legal basis. The court further noted that a caveat, like an injunction, requires a demonstrable basis, which was absent in this case. Consequently, the court allowed the applicant's motion for removal of the caveats.
