Procedural Posture

Employment Cause / Judgment

  1. 1 Whether there existed an employment relationship between the Claimant and the Respondents capable of enforcement by the Court.
  2. 2 Whether the Claimant was constructively dismissed by the Respondents.
  3. 3 Whether the Respondents are liable for the alleged employment dues and compensation claimed by the Claimant.

Ratio Decidendi

The Court found that there was no evidence of an employment relationship between the Claimant and the Respondents. The employment contract relied upon was executed by parties all describing themselves as employees, and Windrose Trading Agencies, registered as a business name, could not have directors. The Claimant's own evidence, including email correspondence, indicated that the real employer was Sven Hochman, not the named Respondents. The Court held that to rule otherwise based solely on the business registration would be unjust. Consequently, the Claimant failed to establish a claim enforceable against the Respondents, and the claim was dismissed.
