Miscellaneous Application / Ruling on Application for Leave to File Suit Out of Time

  1. 1 Whether the court has jurisdiction to grant leave to file an employment claim out of time under the Employment Act, 2007.
  2. 2 Whether the applicant's delay in filing the claim due to destruction of court records by fire constitutes sufficient cause for extension of time.

Ratio Decidendi

The court held that the applicant's cause of action arose on 25th July 2008 and, pursuant to Section 90 of the Employment Act, 2007, the claim ought to have been filed by 24th July 2011. The limitation period is substantive and goes to the jurisdiction of the court. The court, following precedent, has no jurisdiction to extend time for employment claims under the Act, regardless of the reasons for delay, including destruction of records by fire. Consequently, the application for leave to file suit out of time was dismissed.
