RULING
This application numbered Misc. Criminal Application No. 4 of 2008 is brought under certificate of urgency. It is seeking leave to file appeal out of time. I certify matter urgent to be heard on priority basis.
The application shall be served upon the State Counsel forthwith for hearing on 25/1/2008 at 9. 00 a.m.
In the meantime further proceedings in Criminal Case No. 1240/2007 at Senior Resident Magistrate Kerugoya is stayed pending hearing and determination of this application.
