Ratio Decidendi

The court found that the supporting affidavit to the applicant's motion was defective because it was commissioned by a firm of advocates rather than an individual commissioner for oaths, contrary to Section 4(1) of the Oaths and Statutory Declarations Act. This was the second time the applicant had presented a defective affidavit. As a result, the motion was incompetent and could not be considered on its merits. The court therefore struck out the Notice of Motion dated 28th February 2023 with costs to the respondent.
