Procedural Posture

Civil Suit / Application for Leave to Proceed With Suit Against Company Under Statutory Management

  1. 1 Whether leave of court is required under Section 228 of the Companies Act to proceed with a suit against a company under statutory management but not under a winding up order or interim liquidator.
  2. 2 Whether the appointment of a statutory manager under Section 67C of the Insurance Act is equivalent to the appointment of an interim liquidator under Section 235 of the Companies Act.
  3. 3 Whether the plaintiff's failure to obtain leave before filing suit is fatal or curable.
