The court also held that the applicant did not provide sufficient cause for the delay in seeking leave to appeal out of time, as the application was filed approximately seven weeks after the ruling was delivered and no adequate explanation for the delay was given. Consequently, both prayers for stay of execution and leave to appeal out of time were declined, and the application was dismissed with costs to the respondents.
