Tribunal Appeal / Ruling on Application for Stay and Review of Consent Order

  1. 1 Whether the Tribunal should stay execution of the consent order dated 8th April, 2019 and consequential orders.
  2. 2 Whether the Tribunal should review or set aside the consent order made on 15th April, 2019.
  3. 3 Whether the application raises any new issues not previously determined by the Tribunal or the High Court.

Ratio Decidendi

The Tribunal found that the application did not raise any new issues that had not already been determined by both the Tribunal and the High Court. The consent order dated 8th April, 2019, and the consequential orders, had been upheld as valid and enforceable by the High Court, and the Tribunal had previously found no adequate reasons to vacate or review the consent. The Tribunal condemned the applicant's continued retention of goods in defiance of its orders and held that the application was an attempt to unnecessarily prolong the matter and deny the respondent justice. Accordingly, the Tribunal dismissed the application, finding no basis to grant the orders sought.
