The court found that the appellant had not demonstrated any substantial loss that would result from payment of the decretal sum, as the amount was modest and there was no evidence or allegation that recovery from the respondent would be difficult if the appeal succeeded. The application for stay was made promptly, but the absence of demonstrated substantial loss was fatal to the application. The court held that an obligation to pay a decretal sum, particularly one of modest value, does not constitute substantial loss under Order 42 rule 6(2) of the Civil Procedure Rules. Consequently, the application for stay of execution was dismissed with costs.
