Ratio Decidendi

The court found that the trial magistrate failed to consider the appellants' submissions, which were on record prior to judgment, and that the award of Kshs.600,000 for general damages was on the higher side given the respondent's injuries (cracked/loose upper molars and blunt chest injury with no permanent disability). Upon reviewing comparable authorities and considering inflation, the court determined that a reasonable award for general damages should be Kshs.350,000. The appellate court therefore set aside the trial court's award and substituted it with Kshs.350,000 for general damages, upholding the special damages as awarded.
