Ratio Decidendi

The court held that the application before it was not strictly an application to extend time under rule 4, but rather an application for leave to file an application to reinstate an appeal dismissed for non-appearance. The Judge found that, in so far as any leave to file such an application is required, leave should be granted. The Judge was not convinced that leave was strictly necessary, but in the interests of justice and given the applicant's explanation for the delay, leave was granted to allow the applicant to pursue the reinstatement of the dismissed appeal. The absence of opposition from the respondent, who was deceased and unrepresented, was also noted.
