Ratio Decidendi

The Tribunal found that the applicant failed to serve the outgoing advocates, Wandambwa Advocates, with the application to change advocates as required by Order 9 Rule 9 of the Civil Procedure Rules. Without proper service and compliance with the procedural requirements, the application for change of advocates could not be granted. Consequently, since the firm of E.S. Ochieng & Company Advocates was not properly on record, all other prayers in the application, including substitution and enforcement of the judgment, failed. The Tribunal dismissed the entire application with costs to the respondents.
