The Tribunal found that although the tenancy agreement was for a period exceeding five years, it contained a termination clause permitting the Tenant to terminate the lease at any time with six months' notice. This clause allowed for termination within five years from the commencement of the tenancy, thus bringing the agreement within the statutory definition of a controlled tenancy under Section 2(1)(b)(ii) of the Act. Furthermore, the Tribunal held that the arbitration clause in the agreement, which purported to oust the Tribunal's jurisdiction, was void to the extent that it precluded the operation of the Act, pursuant to Section 3(6)(a).
