Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial magistrate erred in awarding excessive general damages for injuries sustained by the 1st respondent.
  2. 2 Whether the trial magistrate failed to consider relevant authorities and submissions on quantum.
  3. 3 Whether the appellate court should interfere with the trial court's discretion in assessment of damages.

Ratio Decidendi

The High Court found that the trial magistrate's award of Kshs.280,000 in general damages was on the higher side given the nature of the injuries, which included blunt injuries to the head, chest, neck, and abdomen, and cut wounds to the left ear and above the right eye, but with no indication of permanent disability. The court considered comparable authorities and inflation factors, concluding that Kshs.200,000 was a more suitable award. The court also found no evidence that the trial magistrate disregarded the appellant's submissions or authorities. Consequently, the award for general damages was reduced to Kshs.200,000, and the appeal succeeded only to that extent.

Court Disposition

Appeal partially allowed; general damages reduced; other awards affirmed.
