The court held that there was lawful justification to interfere with the trial court's discretion, as the award was not consistent with comparable cases and the injuries suffered. Guided by precedent, the court reassessed the general damages to Kshs. 250,000, subject to a 20% contribution, resulting in a net award of Kshs. 200,000. The special damages of Kshs. 5,105 were upheld as unchallenged. Each party was ordered to bear their own costs of the appeal, as the appeal was limited to quantum.
