The Tribunal found that the current committee of the respondent Sacco was not in office at the time the warrants of arrest were issued and that they have demonstrated willingness to settle the decretal sum. The imminent threat of arrest was deemed to impede the new committee's efforts to revive the Sacco and comply with the Tribunal's orders. In the interest of justice and to facilitate payment, the Tribunal invoked its discretion under Order 22 Rule 22(1) of the Civil Procedure Rules to stay execution of the warrants for three months.
