The court held that the magistrate’s court did not err in taxing costs as long as the taxation was within Schedule 7 of the Advocates Remuneration Order. Although the consent judgment was all-inclusive, the appellants failed to challenge the taxation through the appropriate procedure (reference or appeal) and instead filed an application to set aside execution, which was not the correct remedy.
