Ratio Decidendi

The Tribunal found that although the respondent filed a defence without a formal memorandum of appearance, this omission was a procedural technicality rather than a substantive defect. The Tribunal exercised its discretion under Rule 4 of the Co-operative Tribunal (Practice and Procedure) Rules and Article 159(2)(d) of the Constitution to disregard the procedural lapse. The Tribunal held that the absence of a memorandum of appearance did not prejudice the substance of the proceedings or the claimant's position.
